    64 – Offense of Infringing on Copyright and Neighboring Rights

    1. Any person who knowingly engages in any of the actions mentioned in Article 62(1) shall be considered to have committed an offense of infringing on copyright, neighboring rights, or expressions of folklore, as applicable.

    2. Anyone who commits an offense of infringing on copyright or neighboring rights shall be punished by imprisonment or a fine, and in the case of repetition, both penalties shall be imposed.

    3. The rights holder may claim financial compensation for lost earnings, damage to reputation, or infringement of their rights.

    4. For the purposes of subsection (1), a person is considered to be “knowing” if they are aware that they are infringing or have reasonable grounds to believe so, or if they could have known by exercising the necessary care and caution.

    65 – Sanctions in Cases of Violations and Infringements

    In cases of violations or infringements under this law, the court shall take the following actions:

    (a) Confiscate the proceeds from sales in favor of the rights holder whose rights were infringed,

    (b) Order the infringer to pay financial compensation for lost earnings, damage to reputation, or violation of rights,

    (c) Order the cessation of the infringement,

    (d) Upon the request of the rights holder, order the destruction or disposal of copies of the infringing works or those subject to the copyright or neighboring rights infringement,

    (e) Order the confiscation of the infringing copies, equipment, and materials used in committing the violation, for the benefit of the rights holder,

    (f) Publish the court’s ruling in one or more daily newspapers at the expense of the defendant.

    66 – Penalties

    1. Subject to the provisions of Article 63 and without prejudice to any more severe penalties prescribed by any other law, anyone who violates the provisions of this law, its regulations, or any orders or rules issued under it shall be punished by imprisonment for a period not exceeding two years, a fine, or both penalties together.

    2. In all cases where a violation of the provisions of this law occurs, the court may order the confiscation of the exhibits subject to the violation for the benefit of the Council.
